This website is operated by the Michigan Model for Health™ Program. Throughout the site, the terms "MMH", “we,” “us,” and “our” refer to Michigan Model for Health™. The MMH website and associated systems are offered to licensed users (“system users,” “licensees,” or “license holders”) conditioned upon acceptance of these Terms of Service.
By visiting or using this site and its services, users agree to be bound by these Terms of Service, including additional policies referenced herein or linked by hyperlink. These Terms apply to all users of the system.
Please read these Terms carefully. If you do not agree, you may not access or use the system.
Any new features or tools added to the website are also subject to these Terms of Service. MMH reserves the right to update, modify, or replace any part of these Terms by posting updates to the website. Users are responsible for reviewing this page periodically. ROLES AND RESPONSIBILITIES
Schools and districts act as the data controllers for any personal information managed within their organization. MMH functions as a service provider and processes limited user information solely for the purpose of delivering and supporting the program. License Managers and educators are responsible for following their local district and organizational policies regarding data privacy and security. License Managers may generate reports and export account-related information. Organizations are responsible for the storage, handling, and protection of any exported data in accordance with their local policies.
THIRD-PARTY SERVICES
Third-party links on this site may direct system users to third-party services and websites that are not affiliated with MMH. MMH is not responsible for the privacy, security, or accessibility practices of third-party platforms linked or embedded within the system. MMH is not responsible for examining or evaluating the content or accuracy of third-party materials and does not warrant and will not have any liability or responsibility for any third-party materials, websites, products, services, or resources. MMH is not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites.
Users are responsible for reviewing third-party policies and practices and ensuring understanding of those policies before engaging in any transaction. Complaints, claims, concerns, or questions regarding third-party products or services should be directed to the third party.
The Michigan Model for Health™ resources may include links to or integrations with third-party platforms such as Google, Microsoft, video hosting services, etc. These services operate under their own terms and privacy policies, and MMH is not responsible for their data practices.

USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS
If, at our request, a system user sends certain specific submissions (for example contest entries) or without a request from us they send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), system users agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that they forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.
We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable, or that violates any party’s intellectual property or these Terms of Service.
System users agree that their comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. System users further agree that their comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus, malware or other harmful code that could in any way affect the operation of the Service or any related website. System users may not use a false e-mail address, impersonate another person or entity, or otherwise mislead MMH or any third party as to the origin of any comments. System users are solely responsible for any comments they submit and their accuracy. MMH takes no responsibility and assumes no liability for any comments posted by system users or any third-party.

Schools and districts act as the data controllers for information entered into or managed within their organization. The Michigan Model for Health™ (MMH) Program acts as a service provider and processes limited user information solely for the purpose of delivering and supporting the platform.
The submission of personal information through the website is governed by the MMH Privacy Policy. MMH follows State of Michigan policies as a guiding framework for security, privacy, and accessibility practices.
MMH collects limited personal information necessary to operate the system and provide access to authorized users. This may include name, email address, organization or district affiliation, and license-related information. This information is used for account access, communication, and program administration.
Student Data
The Michigan Model for Health™ (MMH) system is designed for educator use and does not provide student user accounts. MMH does not directly collect or maintain student personal information through its platform. Any student data generated through the use of MMH materials (such as worksheets, forms, assessments, or documents) is created, managed, and stored by the school or educator. Schools and districts are responsible for handling, storing, and deleting student data in accordance with their local policies and applicable laws, including FERPA.
SECURITY
The State of Michigan, as developer and manager of the Michigan Model for Health™ (MMH) website, has implemented measures intended to help protect the integrity of its systems and reduce the risk of unauthorized access to information maintained in agency computer systems. The Michigan Model for Health™ (MMH) Program follows State of Michigan policies as a guiding framework for security, privacy, and accessibility practices. Reasonable administrative, technical, and physical safeguards are in place; however, no system can be guaranteed to be completely secure. In the event of a security incident involving unauthorized access to personal information, MMH will take reasonable steps to investigate and respond in accordance with applicable legal and regulatory requirements.
Account Security
Authorized users are responsible for maintaining the confidentiality of account credentials, including usernames and passwords. Account sharing is not permitted. Each user must access the system using their assigned credentials only. License Managers are responsible for managing authorized access within their organization and ensuring accounts are assigned appropriately.
DATA RETENTION
The Michigan Model for Health™ (MMH) Program retains user account and license information only as long as necessary to support active licenses and meet administrative, legal, or operational requirements. Schools and educators are responsible for managing and deleting any student-related data created through use of MMH materials.
ACCESSIBILITY POLICY
The Michigan Model for Health™ (MMH) Program recognizes the importance of making its online content available to the widest possible audience. The MMH website follows the State of Michigan accessibility policies as a guiding framework and works toward alignment with Title II of the Americans with Disabilities Act (ADA), Section 508 of the Rehabilitation Act, and Web Content Accessibility Guidelines (WCAG) 2.1 Level AA standards. Accessibility improvements are actively being aligned and ongoing, and some content may not yet fully conform. ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after system users have submitted their order).
We undertake no obligation to update, amend or clarify information in the Service or on any related website except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.
PROHIBITED USES
In addition to other prohibitions as set forth in the Terms of Service, users are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate a system users use of the Service or any related website for violating any of the prohibited uses. Unauthorized sharing or distribution of Michigan Model for Health™ curriculum content outside authorized licensed system users is strictly prohibited.
PROGRAM COPYRIGHT
All curriculum content is the exclusive intellectual property of Michigan Model for Health™ (MMH) Program or the original copyright holder. System users and license holders are strictly prohibited from engaging in:
- Recording, reproducing, or distributing any part of the curriculum content in video, audio, or other recorded forms for any purpose.
- Uploading or sharing original or modified curriculum content to public platforms, websites, or non-approved online spaces (e.g., social media, YouTube, public file-sharing services, or other third-party websites).
- Using third-party recording products to video record curriculum content for any instructional or non-instructional purposes. This includes using video recording software or apps (e.g., screen recording, live streaming tools) that capture and redistribute content.
- Removing or obscuring copyright notices, logos, or attribution from the content, whether modified or unmodified.
- Commercial use of the curriculum content or modified materials, including selling, licensing, or distributing content outside of the institution or educational setting.
- Redistributing curriculum materials to unauthorized individuals or institutions, even in modified form.
- Claiming ownership of the curriculum content or its modifications, either partially or in full.
System users or license holders wishing to reproduce or adapt Michigan Model for Health™ Program educational content for classroom use must submit a formal request to the content publisher. This request should detail the specific content to be reproduced or adapted, the intended purpose (e.g., lesson plans, presentations, assessments), the format (e.g., print, web-based, online), and the scope of use (e.g., duration, number of copies, distribution). All requests should be submitted in writing, with a clear explanation of how the content will be utilized within the educational context. Approval is required before any reproduction or adaptation can occur, and content usage must comply with the terms outlined in this agreement.
PERMITTED USE OF MATERIALS
The Michigan Model for Health™ curriculum content and resources are licensed for use only by authorized system users for classroom instruction. Materials may not be shared, distributed, or used outside the scope of the license. Users must follow all program guidelines regarding appropriate use of lesson materials and resources. Access credentials are issued for individual use only and may not be shared, transferred, or used by multiple individuals.
MODIFIED CONTENT
The Michigan Model for Health™ Program is not responsible for any content that has been modified, adapted, or redistributed by users. Responsibility for the review, approval, and use of modified materials rests with the applicable school or district.
DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
We do not guarantee, represent or warrant that a system users use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. System users agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to the system user.
System users expressly agree that their use of, or inability to use, the service is at the system user's sole risk. The service and all products and services delivered to system users through the service are (except as expressly stated by us) provided 'as is' and 'as available' for their use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Michigan Model for Health™, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from the system user's use of any of the service or any products procured using the service, or for any other claim related in any way to the system user's use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
INDEMNIFICATION
System users agree to indemnify, defend and hold harmless Michigan Model for Health™ and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of a system user's breach of these Terms of Service or the documents they incorporate by reference, or the system user's violation of any law or the rights of a third-party.
SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either the system users or us. System users may terminate these Terms of Service at any time by notifying us that the system user no longer wish to use our Services, or when the system users cease using our site.
If in our sole judgment the system user fails, or we suspect that the system user has failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and the system user will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny the system user's access to our Services (or any part thereof).
ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between the system user and us and governs the system user's use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between the system user and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide Services to system users shall be governed by and construed in accordance with the laws of Michigan.
CHANGES TO TERMS OF SERVICE
System users can review the most current version of the Terms of Service at any time at this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is the system user's responsibility to check our website periodically for changes. System users continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
